Opened your account before October 26, 2026? The terms of October 19, 2026 apply to you until November 12, 2026, when these do.
These terms protect three things: your ownership of your app, Apphaven's ability to stop abuse quickly, and the fact that an AI agent acting in your account is you acting.
These terms are between you and Efficacious, Inc. ("Apphaven", "we"). By creating an account or connecting an AI agent to Apphaven you agree to them. You must be 18 or older and able to enter a contract. If you use Apphaven for a business, you agree for that business and confirm you may.
Keep your sign-in private. You're responsible for everything done in your account, including everything your AI agent does there. Connecting an agent authorizes it to build, change and test your apps, and to work with your live apps' data and accounts when you ask it to; the first time an app goes live, you publish it from the dashboard. What the agent does in a live app, its checks included, counts toward that app's plan. To disconnect an agent, remove Apphaven in the agent's own settings; access tokens are removed from the dashboard.
You own the apps you build, their files, configuration and data. You give us the permission we need, for as long as the app exists and for the copies the privacy policy says we keep, to: host, run, back up and display them; send the email they ask us to send; check and scan what's uploaded to them, as sections 11 and 12 describe; give the agent you connect what it asks for; and keep records of how agents build and change apps on Apphaven, which we use to fix problems and improve the service. We claim no rights beyond that.
Code and packages your agent uses keep their own licences, which are yours to follow. The build service is for building your app and nothing else.
People who sign up to your app are your users. You decide what you collect from them and you're responsible for telling them, following the law that applies to you (including any privacy notice your app needs, and that your AI agent may read their data when it works on your live app). For their data we act on your instructions, including those you give through your agent: we use it only to run your app, keep it confidential, help you answer their requests, and tell you without undue delay about a breach that affects them, as our privacy policy describes.
Don't use an app to collect card numbers (take payments through a payment service), or health records or other data the law says needs a special agreement with your host; we don't sign those yet.
Don't use Apphaven to break the law, to harm people, or to pretend to be someone you're not. In particular, no: phishing or anything that imitates another organization's sign-in or brand; malware or attacks on other systems; collecting data from children under 13; unsolicited or bulk email; sexual content involving anyone under 18; intimate images of anyone shared without their consent; harassment or threats; other people's copyrighted work used without permission; content that is illegal where you or your users are. Don't try to get around the limits of the service, probe other people's apps, or resell access.
Apps may send sign-in mail and notifications about events in the app to the people in it. Every notification Apphaven sends for an app carries an unsubscribe link, which we honor. We set sending limits, which the pricing page describes, and may pause an app's sending if its mail bounces or is reported as spam.
A test version is private to you and may be changed or reset at any time. Publishing makes a live version public at its address. You're responsible for what's live. You can point a domain you control at a live app; keeping it registered and pointed at the app is up to you, and its name appears in public certificate records.
Building and testing are free. Publishing a live app requires a monthly plan per app, unless we've given your account free live apps; the current plans and prices are on the pricing page and shown again before you pay. If a plan starts with a free trial, we show its length before you start, and the first charge comes when it ends unless you cancel first. Big plans also charge for use past the amounts included, at the unit prices shown there, at the start of the following month, or when the plan changes or ends.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle collects applicable sales tax or VAT and issues your receipts; we never see your card number. Payments your own app takes are yours, not ours or Paddle's.
Plans renew monthly until you cancel from your app's settings or through Paddle. Cancelling takes effect at the end of the period you've paid for; the live app then pauses, and its data is kept for at least 90 days, after which we may delete it once we've emailed you. Deleting a live app ends its plan at once. Moving to a bigger plan is charged pro rata at once; moving to a smaller one takes effect at once and the difference is credited against your next renewal. If a payment fails we tell you and retry for up to 30 days; the app keeps working meanwhile, and pauses if the payment can't be made.
Free live apps stay free until we email you, at least 30 days ahead, that they need a plan; if you don't choose one by then, the live app pauses and its data is kept as above. We also email you at least 30 days before a change to a plan's price or allowances applies to your app.
Refunds. If you're not happy with a plan, email billing@apphaven.com within 14 days of a charge and we refund it in full. Charges for use past a Big plan's included amounts, and charges older than 14 days, are refundable where the law requires or where something on our side went wrong. Refunds go back to the original payment method. The full refund policy is part of these terms.
We'll run the service with reasonable care, keep your data as the privacy policy says, and tell you about planned changes that affect your apps. Apphaven is early; features may change and there is no uptime guarantee yet. Each plan's allowances, and what happens when an app goes past them, are on the pricing page: we slow or hold what's over rather than take the app offline, and use far past any plan is looked at by a person, who talks to you first. Other limits (apps, storage, email, requests) may change with notice, and changes to plans with the notice in section 8.
We may suspend or remove an app, or an account, that breaks these terms or puts other users, our providers or our reputation at risk. We'll tell you why unless the law prevents it, and where practical give you a chance to fix it first.
Your app's users can add things to it: text, and with photo and file fields, photos, documents and other files; your app may make files too. You're responsible for what's in your app, including what they add, and for dealing with reports about it. These terms' rules on what can't be hosted apply to all of it. We check that files are what they claim to be, not that they're free of viruses.
Anyone can tell us about content on an app at apphaven.com/report or abuse@apphaven.com. We look at every report. We may remove content that breaks these terms or the law, without asking you first when the law or someone's safety requires it, and we act on reports of intimate images shared without consent within 48 hours. When we remove a file, we tell you which one and why, unless the law prevents it, and identical copies of it anywhere on Apphaven go too and can't be uploaded again. Images on apps are checked automatically against known child sexual abuse material. We report sexual content involving children to the National Center for Missing & Exploited Children and keep what we report, as the law requires; we don't tell the app's owner about those reports. If you think something was removed by mistake, reply to our email.
If you believe something on an app copies your work without permission, send a notice through the report page or to our designated agent: Andrew Przybilla, Efficacious, Inc., 1037 NE 65th St #80978, Seattle, WA 98115; phone 320-424-3473; andrew@efficacious.io. The notice needs: your signature; the work you say is copied; where on Apphaven the copy is; how to reach you; a statement that you believe in good faith the use isn't authorized by you, your agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you're the owner or authorized to act for them.
When we remove something after a notice, we tell the app's owner, who may send a counter-notice by replying: their name, address and phone number; what was removed; a statement under penalty of perjury that they believe in good faith it was removed by mistake or misidentification; consent to the federal court for their address (or, outside the United States, any judicial district where Apphaven may be found) and to accept service from the person who sent the notice; and their signature. We forward it to that person and put the content back 10 to 14 business days later, unless they tell us they've filed a court action.
We close the accounts of owners who repeatedly infringe others' copyright, or whose apps repeatedly host infringing content they don't deal with, in appropriate circumstances.
Delete your apps from the dashboard any time. To close your account, email support@apphaven.com from its address; we close it within 30 days and delete its apps and their data as the privacy policy describes. We may close an account that has been inactive for 12 months and has no live app on a plan, after emailing you, or for breach under section 10.
The service is provided as is. Your agent's output is the agent provider's and yours, not ours; we don't review apps before they go live. To the extent the law allows, we're not liable for indirect or consequential loss, and our total liability to you is limited to what you paid us in the 12 months before the claim.
We'll post changes with a date. For material changes we email account holders at least 14 days before they apply to existing accounts; new accounts agree to the terms in force when they sign up. Changes that only cover a new feature, or that the law requires, apply when posted.
Delaware law applies. Disputes go to the state and federal courts in New Castle County, Delaware, unless your local law gives you other rights.
